AN ACT

RELATING TO MEDICAL INSURANCE POLICIES; PROVIDING THAT FEDERAL DRUG ADMINISTRATION-APPROVED EXPERIMENTAL TREATMENTS OR PROCEDURES BE COVERED BY INDIVIDUAL OR GROUP HEALTH INSURANCE AND OTHER POLICIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of Chapter 59A, Article 22 NMSA 1978 is enacted to read:

"[NEW MATERIAL] COVERAGE FOR FEDERAL DRUG ADMINISTRATION-APPROVED EXPERIMENTAL TREATMENTS OR PROCEDURES.--Each individual and group health insurance policy, health care plan, certificate of health insurance and managed health care plan delivered or issued for delivery in New Mexico shall provide coverage for federal drug administration-approved experimental treatments or procedures."

Section 2. A new section of Chapter 59A, Article 23 NMSA 1978 is enacted to read:

"[NEW MATERIAL] FEDERAL DRUG ADMINISTRATION-APPROVED EXPERIMENTAL TREATMENTS OR PROCEDURES.--Each insurer that delivers or issues for delivery a group health insurance policy in New Mexico shall include coverage for federal drug administration-approved experimental treatments or procedures."
