Your CONSERVATION COMMITTEE, to whom has been referred

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 24, after "The" insert "water".

2. On page 1, line 25, after "association" strike the remainder of the line.

3. On page 2, line 1, strike "their use".

4. On page 2, lines 3 and 4, strike "or for nonuse of waters".

5. On page 2, line 5, after the period insert the new sentence:

"Water rights owned by an acequia or community ditch association shall not be lost for nonuse of waters, except for water rights that reverted to the public pursuant to Section 72-5-28 NMSA 1978 prior to July 1, 2001.".,

and thence referred to the JUDICIARY COMMITTEE.
