AN ACT

RELATING TO THE COUNSELING AND THERAPY PRACTICE ACT; PROVIDING FOR PROVISIONAL LICENSURE FOR CERTAIN COUNSELOR AND THERAPIST PRACTITIONERS; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Counseling and Therapy Practice Act is enacted to read:

"[NEW MATERIAL] PROVISIONAL LICENSURE.--

A. Prior to an examination, an applicant for licensure may apply for and obtain a provisional license to engage in any counseling and therapy practice licensed or registered pursuant to the Counseling and Therapy Practice Act if the applicant has a current valid license or other regulatory document authorizing the applicant to practice in another state and if the applicant will practice in New Mexico within the scope of practice of that license or other regulatory document authorizing the practice.

B. The provisional license is valid for the period, not to exceed three years, that is necessary for the applicant to complete any additional requirements for education, experience or supervision and examination that are required under the Counseling and Therapy Practice Act for the license sought by the applicant. The applicant shall also provide the board with a personal development plan for licensure showing how and when the applicant will obtain the necessary courses, training or experience and complete the examination needed for licensure.

C. The board shall issue a provisional license within five working days after the date the board receives the application upon proof satisfactory to the board of the applicant's licensure or other regulatory document authorizing the applicant to practice in another state and payment of the license fee."

Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
