AN ACT

RELATING TO ARCHITECTURAL BARRIERS; CREATING A BARRIER REMOVAL FUND; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. BARRIER REMOVAL FUND--CREATED--ADMINISTRATION.--The "barrier removal fund" is created in the state treasury. The fund shall consist of appropriations, gifts, grants, donations, earnings from investment of the fund and any other money credited to the fund. Money in the fund at the end of a fiscal year shall not revert to any other fund. The fund shall be administered by the governor's committee on concerns of the handicapped, and money in the fund is subject to appropriation by the legislature to the governor's committee on concerns of the handicapped to assist local governments in the removal of architectural barriers in public spaces, including curb cuts for sidewalks.

Section 2. APPROPRIATION.--Five million dollars ($5,000,000) is appropriated from the general fund to the barrier removal fund for expenditure in fiscal year 2001 and subsequent fiscal years to carry out the purposes of the fund. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
