SUMMARY

Synopsis of Bill

House Bill 567 proposes to amend Section 4-38-6 NMSA 1978 to provide that the county clerks are to be employed by the county manager or board of county commissioners.

Significant Issues

The bill strikes all references to the county clerk in statute. In addition, the bill has a contingent effective date, which is the January 1 after the people have adopted a constitutional amendment entitled "PROPOSING AN AMENDMENT TO THE CONSTITUTION OF NEW MEXICO TO ABOLISH THE ELECTED POSITION OF COUNTY CLERK." House Joint Resolution 20 is currently proposing this constitutional amendment.

FISCAL IMPLICATIONS

The bill does not contain an appropriation or a significant fiscal impact.
