SUMMARY



Synopsis of SJC Amendments



The Senate Judiciary Committee amendments change notification from mayordomo or superintendent to mayordomo, superintendent and chairman.



Synopsis of Original Bill



SB 24 provides for notifying the State Engineer and the mayordomo or superintendent of an acequia or community ditch prior to an application of a water rights transfer or point of diversion change.



Significant Issues of SJC Amendments



The amendments increases the responsibility for notification from one individuals to three. The burden does not seem unreasonable.

Taken as a stand alone bill SB 24 is simple and innocuous. However, this bill along with related bills such as HB 156, have the cumulative effect of denying individuals the reasonable right to benefit from market opportunities.



This bill along with others is clarifying the role of individual property rights with the rights of a community based irrigation system.
