Significant Issues

FISCAL IMPLICATIONS

The appropriation of $639.5 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of FY02 shall revert to the general fund.

RELATIONSHIP

SB388 relates to HB2 which contains SAOA's base budget for FY02, and to HB267, Statewide Senior Citizen Programs, which requests funding to enhance services to seniors.

TECHNICAL ISSUES

SAOA indicates the bill language should include "retirement benefits".

POSSIBLE QUESTIONS

1. Do the provisions of the bill conflict with the anti-donation clause of the NM constitution?
