The Senate Education Committee has amended Senate Bill 432. The amendment strikes the appropriation of $500.0.



Synopsis of Original Bill



Senate Bill 432 amends the Public School Code as follows:



Creates an Office of Medicaid in the Schools in the State Department of Education.

Creates a Medicaid in the Schools Advisory Council.

Transfers Personnel, budgets funds, appropriations, records, contracts, equipment and other property of the Human Services Department (HSD) used to administer the Medicaid in the Schools Program to the SDE.



Significant Issues

This legislation requires the HSD and SDE to enter into an agreement pertaining to the administration of the Medicaid in the Schools Program and to resolve any disputes that arise through binding arbitration.



This act contains an emergency clause.



The legislation requires the Office of Medicaid in the Schools in the SDE to:



Administer the Medicaid in the Schools Program.

Adopt rules and establish accountability measures and training schedules.

Consult with the Medicaid in the Schools Advisory Council on all matters relating to Medicaid in the Schools Policy.

Assist school districts in developing local collaborative plans for Medicaid in the Schools.

Assess the status of the Medicaid in the Schools Program for compliance.

Report annually to the State Board of Education, Legislative Finance Committee and the Legislative Education Study Committee.



FISCAL IMPLICATIONS



Senate Bill 432 appropriates $500.0 to SDE and is recurring.



ADMINISTRATIVE IMPLICATIONS



This legislation would require the SDE to establish an Office for Medicaid in the Schools and administer the Medicaid in the Schools Program.
