SUMMARY



Synopsis of Bill



Senate Bill 711 provides that the Property Control Division of the General Services Department shall provide free access to state buildings by the motion picture industry.



Significant Issues



According to the Film Division of the Economic Development Department, the bill would lead to increased productions in New Mexico, both from out-of-state and local production companies. The Property Control Division indicates that it currently provides access to state buildings at a reasonable market rate, which is required by law.



FISCAL IMPLICATIONS



The bill would have a minor negative effect on the Public Buildings Repair Fund. According to GSD, the Property Control Division collects an average of $5.0 per year from the lease of state facilities. Part of this revenue would be lost from the motion picture industry leases.



TECHNICAL ISSUES



Section 15-3-14 NMSA 1978 requires the Property Control Division to charge reasonable market rates for the private use of state facilities. This section would need to be amended or repealed.
