SUMMARY



Synopsis of Bill



SB 765 appropriates $50,000 to the OCA to contract for historical preservation services in Albuquerque's Huning Highland neighborhood.



     Significant Issues



The OCA says that the general wording of SB 765does not provide sufficient guidance on implementation so that they can successfully disburse these funds within FY 2002. In addition OCA claims that if these funds are intended for an entity other than a subdivision of the State, the anti- donation clause may impact implementation of the bill.



Within the Huning Highland neighborhood two of the many designated historic properties are: the Huning Highland Historic District listed on the State Register of Cultural Properties and the National Register of Historic Properties, and the Charles Whittlesey House which is listed on the State Register of Cultural Properties. State funds going to a subdivision of the State for preservation planning services or rehabilitation of a particular building within the Huning Highland neighborhood would likely implicate provisions of state statutes for preservation and protection of cultural resources.





FISCAL IMPLICATIONS



SB 765 appropriates $50.0 to OCA to contract for historical preservation services in Albuquerque's Huning Highland neighborhood county for expenditure in fiscal year 2002. Any unexpended or unencumbered balance remaining at the of fiscal year 2002 shall revert to the general fund.



ADMINISTRATIVE IMPLICATIONS



OCA would appreciate more guidance on the intent of SB 765. They cannot provide administrative implications at this time.
