AN ACT

RELATING TO GUARDIANSHIP SERVICES; PROVIDING FOR THE ATTORNEY GENERAL'S OFFICE TO CONTRACT FOR THE ADMINISTRATION OF GUARDIANSHIP SERVICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 8-5-16 NMSA 1978 (being Laws 1995, Chapter 140, Section 1) is amended to read:

"8-5-16. [OFFICE OF] GUARDIANSHIP SERVICES.--

A. [An "office of guardianship services" shall be established within the] The attorney general's office shall negotiate and contract for the administration of guardianship services through a guardianship program. The [office] administrative contractor shall consolidate guardianship services currently existing in various state agencies and shall negotiate and administer contracts with subcontractors for guardianship services with community service providers.

B. Quality assurance for participants in the guardianship program shall be implemented by the attorney general's office.

C. The attorney general's office and the state agency on aging shall share all complaint and investigation duties relating to the administration and providing of services for the guardianship program. The state agency on aging shall have access to all information relating to the guardianship program and its participants.

D. The administrative contractor and subcontractors shall provide quarterly reports to the attorney general, director of the state agency on aging, the legislative finance committee and any other appropriate legislative interim committee."
