SUMMARY

 

     Synopsis of Bill

 

House Bill 393 establishes a review and approval process for an educational program “ that is conducted , sponsored, carried on a caused to be carried on by private organization or agency.”

 

     Significant Issues

 

The approval process includes:

 

            -    Local board notification

-        Requirement for the local board to hold a public hearing

-        Requirement that the approved program be submitted to the State Board of Education for approval

-        Requirement  for parental permission.

 


FISCAL IMPLICATIONS

 

No fiscal impact.

 

OTHER SUBSTANTIVE ISSUES

 

According to SDE, the requirements of this bill could result in a significant increase in responsibilities and time needed by local districts and boards in the required dissemination and public hearing process. A great deal of local educational material could be considered to be “sponsored” by a private organization.

 

The department indicates the State Board of Education is the process of addressing the issue raised in this bill through a board regulation.  In contrast to House Bill 393, the board regulation only calls for a review of local curriculum if it determined to be out of compliance with state content standards and benchmarks. An appeal to the State Board of Education will only occur if non-alignment of curriculum to standards is the issue.
