SUMMARY

 

     Synopsis of Bill

 

House Joint Memorial 81 requests the State Board of Education to provide the public and the school district with input prior to making major regulatory changes affecting the state’s public schools.

 

     Significant Issues

 

The memorial request the president of the State Board of Education report all action taken with regard to the memorial to the appropriate interim legislative committee prior to the first session of the 46th legislature.

 

FISCAL IMPLICATIONS

 

According to SDE, the department would be required to absorb any fiscal impact within existing resources.

 

ADMINISTRATIVE IMPLICATIONS

 

According to SDE, a formal process addressing all components of the memorial can be anticipated to result in significant administrative impact, which would be borne within existing staff  resources.

 

OTHER SUBSTANTIVE ISSUES

 

The SDE indicates that the State Board of Education currently follows a process whereby a Notice of Proposed Rulemaking is published , proposed rules are mailed to local school districts and other interested parties and at least one public hearing is held regarding the proposed rule.
