SUMMARY

 

     Synopsis of Bill

 

House Joint Resolution 6 proposes to amend Article 7, Section 5 of the Constitution of New Mexico to allow municipalities to conduct runoff elections.

 

     Significant Issues

 

The joint resolution provides that a candidate who receives the highest number of votes for an office shall be declared elected to that office unless the municipality provides for runoff elections.  HJR 6 provides that a municipality that has not adopted a charter pursuant to Article 10, Section 6 f the Constitution of New Mexico may provide for runoff elections by ordinance.  Also, if a municipality has adopted a charter, then it may provide for runoff elections if the charter already approves them or if a charter amendment to allow for runoff elections is adopted by a majority of the qualified electors. 

 

FISCAL IMPLICATIONS

 

There is no appropriation associated with this joint resolution.  According to the Secretary of State, there is an approximate cost of $30.0 for the printing, advertising and language translation of the proposed constitutional amendment, if adopted.
