     Synopsis of  SPAC Amendment #1 

 

The amendment restores the wording in current law that allows a patient who is covered under SB 10 to appeal to the Superintendent of Insurance. The appeal must be expedited and resolved within thirty days. Programs pursuant to Title 19 or Title 21 of the federal Social Security Act, which have their respective expedited appeal processes, are exempted out of the above.

 

     Synopsis of Original Bill

 

SB 10 updates the law requiring coverage for cancer clinical trials by updating the definition of an assurance contract.  SB10 removes the exclusion for contracts issued after July 1, 2002.

 

     Significant Issues

 

SB 10 brings current law into conformance with federal terminology and clarifies the effective date.
