SUMMARY

 

     Synopsis of SCORC Amendment

 

The Senate Corporations and Transportation Committee amendment to Senate Bill 279 clarifies that the benefits will apply when soldiers are on state-ordered militia duty, as opposed to other state-ordered duty.

 

     Synopsis of Original Bill

 

Senate Bill 279 proposes to extend the provisions of the Workers’ Compensation Act for members of the State Defense Force when they are on state-ordered militia duty or are traveling to and from that duty. 

 

     Significant Issues

 

DMA indicates that such provision would increase the State Defense Force efficiency, recruitment and membership because members serving in an authorized duty status would have the confidence of insurance coverage if injured on the job.  The WCA points out that the coverage of travel to and from duty is not afforded to any other worker under state law and may cause some dispute. 

 

 

FISCAL IMPLICATIONS

 

There is no appropriation or significant fiscal implication associated with this bill.  There may be slight increases in Workers’ Compensation insurance premiums for the Department of Military Affairs.
