Your JUDICIARY COMMITTEE, to whom has been referred



HOUSE BILL 202, as amended



has had it under consideration and reports same WITHOUT RECOMMENDATION, amended as follows:



1. Strike Energy and Natural Resources Committee Amendment 2.



2. On page 2, line 24, after "private" insert "domestic" and after the semicolon insert "provided that:



(a) all costs associated with the purchase and installation of a totalizing meter be the responsibility of the person contracting for the drilling of the private domestic well;



(b) the owner of the domestic well submit meter readings to the county or municipality on a biannual basis;



(c) the requirement that any domestic well be metered at the time it is put into use shall be made part of the final conditions of approval for the subdivision by the county or municipality; and



(d) if the county or municipality determines that overuse of water from a private domestic well is occurring, a fine may be imposed.".



3. On page 2, strike line 25 and on page 3, strike lines 1 and 2 and insert in lieu thereof the following new paragraphs to read:



"(2) design criteria for low-water use landscaping and efficient irrigation systems based on xeriscape principles; and



(3) regulation of high-water use landscaping.".



4. On page 5, line 23, after "private" insert "domestic" and after the semicolon insert:

5. On page 5, strike lines 24 and 25 and on page 6, strike lines 1 through 3 and insert in lieu thereof the following new subparagraphs to read:

(c) regulation of high-water use landscaping.".
