AN ACT

RELATING TO EDUCATION; PROVIDING FOR A TRANSFER OF POWERS AND DUTIES FROM THE STATE BOARD OF EDUCATION TO THE PUBLIC EDUCATION DEPARTMENT IF THE PEOPLE ADOPT THE PERTINENT CONSTITUTIONAL AMENDMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. TEMPORARY PROVISION--TRANSFER OF POWERS AND DUTIES OF STATE BOARD OF EDUCATION.--If the people adopt a constitutional amendment that eliminates the state board of education as the policymaking body that has control, management and direction of public schools in the state, the powers and duties of the state board of education shall be transferred to the state department of public education until the legislature passes and the governor signs a bill reorganizing the department and reassigning board powers and duties.

Section 2. CONTINGENT EFFECTIVE DATE.--The effective date of this act is contingent upon the passage of a constitutional amendment that eliminates the state board of education as the state's public school policymaking body.
