Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 769

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 21, after "have" insert "full and immediate".

2. On page 1, line 22, strike "the" and insert in lieu thereof "readily available".

3. On page 1, line 22, after "personal" insert a comma and strike the underscored "and".

4. On page 1, line 23, after "records" insert ", which include administrative records, policies, procedures or documents that concern, involve or pertain to a resident's diet, comfort, health, safety or welfare, but do not include internal quality assurance and risk management reports,".

5. On page 1, line 25, after the period insert:

"If the records are not readily available, they are to be provided to the office within twenty-four hours of the request.".

6. On page 2, line 17, strike the underscored "identify,".

7. On page 3, lines 5 through 8, strike the underscored Subsection B in its entirety.

8. Reletter the succeeding subsections accordingly.

9. On page 3, line 25, strike "The" and insert in lieu thereof "In order to carry out its responsibilities as a health oversight agency, the".

10. On page 4, line 2, after "section" insert "and in accordance with the federal Health Insurance Portability and Accountability Act of 1996 regulations".,

and thence referred to the BUSINESS AND INDUSTRY COMMITTEE.
