AN ACT

RELATING TO PUBLIC WORKS; REQUIRING CERTAIN PUBLIC WORKS PROJECT CONTRACTS TO INCLUDE APPRENTICESHIP PROGRAMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. SHORT TITLE.--This act may be cited as the "Public Works Apprenticeship Act".

Section 2. DEFINITIONS.--As used in the Public Works Apprenticeship Act:

A. "apprenticeship program" means a building trades apprenticeship and training program in New Mexico recognized by the bureau of apprenticeship and training of the United States department of labor or the New Mexico apprenticeship council;

B. "public agency" means any state agency, board, department, instruction or political subdivision; and

C. "public works project" means a project of a public agency to construct, repair, alter, demolish, install or extend an improvement on real property or to improve real property owned, used or leased by a public agency.

Section 3. PUBLIC WORKS CONTRACTS--APPRENTICESHIP COMPONENT.--A public works project contract entered into by a public agency valued in excess of one hundred thousand dollars ($100,000) shall include provisions requiring the contractor and any subcontractors to maintain, for the life of the contract, an apprenticeship program.
