AN ACT

RELATING TO GAMING; AMENDING THE GAMING CONTROL ACT TO PROVIDE FOR AN ADDITIONAL FEE FOR GAMING MACHINES LICENSED TO CERTAIN GAMING OPERATORS; MAKING AN APPROPRIATION OF THE PROCEEDS FROM THE FEE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Gaming Control Act is enacted to read:

"[NEW MATERIAL] ADDITIONAL FEE FOR GAMING MACHINES LICENSED TO RACETRACKS--APPROPRIATION OF PROCEEDS.--

A. In addition to the fees imposed pursuant to Section 60-2E-15 NMSA 1978, the board shall impose an annual fee of one hundred fifty dollars ($150) for each separate gaming machine licensed to a person holding a gaming operator's license for a racetrack.

B. The proceeds from the fee imposed pursuant to Subsection A of this section shall be retained by the board and are appropriated to the board to use for software updates to integrate new gaming machines into the gaming machine central system."
