AN ACT

RELATING TO INSURANCE; PROHIBITING HOMEOWNER INSURERS FROM CANCELING OR NOT RENEWING A POLICY BASED ON THE SUBMISSION OF NOT-AT-FAULT CLAIMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the New Mexico Insurance Code is enacted to read:

"[NEW MATERIAL] HOMEOWNER'S INSURANCE--POLICY CANCELLATION--FAILURE TO RENEW.--An insurer shall not cancel or not renew a homeowner's policy based on the submission of claims for which the policyholder is not at fault."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
