Madam President:

Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 12, before the period insert "; PROVIDING THE HUMAN SERVICES DEPARTMENT WITH THE AUTHORITY TO PROMULGATE RULES".

2. On pages 1 and 2, strike Section 2 in its entirety and insert in lieu thereof the following new sections:

"Section 2. A new section of the Public Assistance Act, Section 27-2-12.11 NMSA 1978, is enacted to read:

"27-2-12.11. [NEW MATERIAL] STERILIZATION COVERED BY MEDICAID--AGE OF RECIPIENT.--Medicaid shall cover a medically necessary sterilization for a recipient who is:

A. of the age of majority;

B. capable of giving informed consent; and

C. otherwise qualified to receive medicaid assistance."

Section 3. A new section of the Public Assistance Act, Section 27-2-12.12 NMSA 1978, is enacted to read:

"27-2-12.12. [NEW MATERIAL] AUTHORITY TO ADOPT RULES.--The department shall adopt and promulgate rules regarding the provision of informed consent for medically necessary sterilizations."".

3. Renumber the succeeding section accordingly.,

and thence referred to the JUDICIARY COMMITTEE.
