AN ACT

RELATING TO INSURANCE; LIMITING THE REQUIREMENT TO PROVIDE PROOF OF A DISABILITY TO AN EMPLOYER FOR INSURANCE; ENACTING A NEW SECTION OF THE NEW MEXICO INSURANCE CODE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the New Mexico Insurance Code is enacted to read:

"[NEW MATERIAL] PROOF OF DISABILITY.--An individual who is at least sixty years of age and has certified a disability to an employer for the previous five years shall not again be required to certify that disability to that employer for the purpose of obtaining employer-provided insurance."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
