FOR SENATE BILL 244



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 4, line 12, strike "fifteen" and insert "thirteen".



2. On page 5, line 6, strike "; and", and insert in lieu thereof a period.



3. On page 5, strike lines 7 through 9 in their entirety.



4. On page 13, strike lines 4 through 7 in their entirety and insert in lieu thereof a new subsection "C"



"C. A person who makes an information technology purchase or sale and intentionally fails to comply with the certification requirements set forth in Subsection B of this section is in violation of the provisions of the Procurement Code (13-1-28 NMSA 1978, 1984) and is guilty of a misdemeanor. The person shall also be individually liable to the state for the amount of the purchase and civil penalties as provided under the Procurement Code."
