AN ACT

MAKING AN APPROPRIATION TO PROVIDE COST-OF-LIVING INCREASES TO PROVIDERS AND TO ADDRESS RATE EQUITY BETWEEN TWO STATE DEVELOPMENTAL DISABILITIES PROGRAMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. Three million one hundred sixty-three thousand two hundred dollars ($3,163,200) is appropriated from the general fund to the department of health for expenditure in fiscal year 2004 in the following amounts and for the following purposes:

(1) one hundred sixty-three thousand two hundred dollars ($163,200) to provide cost-of-living increases for employees of intermediate care facilities for the mentally retarded, to address employee recruitment and retention, and to provide for employee health insurance, program liability insurance and other operational costs; and

(2) three million dollars ($3,000,000) to address equity in reimbursement between developmental disabilities programs that are funded entirely with general fund dollars and those that are funded with medicaid waiver dollars.

B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.
