SENATE BILL 447

AN ACT

RELATING TO SPECIAL DISTRICTS; PROVIDING ADDITIONAL POWERS OF DISTRICTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 73-21-3 NMSA 1978 (being Laws 1943, Chapter 80, Section 2, as amended) is amended to read:

"73-21-3. PURPOSE OF WATER AND SANITATION DISTRICTS.--Water and sanitation districts may be created for the purpose of:

A. purchasing, acquiring, establishing or constructing waterworks to supply water for domestic, commercial and industrial purposes by any available means to persons within and without the boundaries of the district [and]. For this purpose, [any] a district [shall have] has the power to extend its water lines outside [of] the boundaries of the district for the purpose of securing a source of water supply or for the purpose of supplying [such] the water to any lands of the United States, [state of] New Mexico or Indian reservations for use by any person, firm or corporation;

B. purchasing, acquiring, establishing or constructing sanitary sewers or a system [or systems] of sewage disposal, garbage or refuse disposal; [or]

C. purchasing, acquiring, establishing or constructing streets and street improvements, including without limitation grades, regrades, gravel, oiling, surfacing, macadamizing, paving, crosswalks, sidewalks, driveway approaches, curbs, gutters, culverts, drains, sewers, manholes, inlets, outlets, retaining walls, bridges, overpasses, tunnels, underpasses, approaches, artificial lights and lighting equipment, parkways, grade separators, traffic separators and traffic-control equipment and all appurtenances and incidentals or any combination [thereof] of them, including real and other property [therefor] for them; [or]

D. establishing or constructing park and recreational improvements or all of [such] the improvements in Subsections A through [D] E of this section or any combination [thereof] of them within or without the district;

E. purchasing, acquiring, establishing, constructing or operating other public works, community facilities or economic development projects;

[E.] F. all of [such] the improvements in Subsections A through [D] E of this section or any combination [thereof] of them within or without the district."
