AN ACT

RELATING TO PUBLIC HEALTH; PROHIBITING SMOKING IN PUBLICLY AND PRIVATELY OPERATED CORRECTIONAL FACILITIES, ON PUBLIC SCHOOL CAMPUSES AND IN CERTIFIED JUVENILE DETENTION FACILITIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. SMOKING--PROHIBITION--PUBLIC INSTITUTIONS.--

A. It is unlawful for any person to smoke:

(1) in a publicly operated correctional facility;

(2) in a privately operated correctional facility;

(3) on a public school campus; or

(4) in a certified juvenile detention facility.

B. To advise persons that smoking is prohibited in the entire public institution and its grounds, signs using the words "No Smoking" or the international no-smoking symbol or both shall be conspicuously posted either on all public entrances or in a position where the sign is clearly visible upon entry into the establishment.
