AN ACT

RELATING TO HEALTH; PROVIDING FOR TESTING OF NEWBORN INFANTS FOR CONGENITAL, GENETIC AND METABOLIC DISORDERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Public Health Act, Section 24-1-6.2 NMSA 1978, is enacted to read:

"24-1-6.2. [NEW MATERIAL] NEWBORN TESTING--CONGENITAL, GENETIC AND METABOLIC DISORDERS.--The department shall adopt rules to require testing of infants, born in health facilities licensed by the department, for congenital, genetic and metabolic disorders prior to being discharged from the facility. The rules shall also require testing of newborns brought to licensed health facilities after birth who have not received congenital, genetic and metabolic testing. Nothing in this section shall be construed to require testing of a newborn infant if the infant's parents object to the testing on grounds that it conflicts with their religious beliefs."
