SUMMARY

 

Synopsis of HBIC Amendments

 

The House Business and Industries Committee amendments make the following technical changes:  

 

1.                  Amends the bill’s title regarding the Professional Psychologist Act to eliminate certain experience requirements, and specify the correct name of the Inspection of Public Records Act.

 

2.                  Provides clean-up language regarding the correct title of the Inspection of Public Records Act and other technical changes.

 

     Synopsis of Original Bill

 

  • HB 145 extends the Sunset dates for the following boards that are administratively attached to the Regulation and Licensing Department (RLD):

 

·        Optometry

·        Chiropractic

·        Dental Health Care

·        Podiatry

·        Psychologist Examiners

·        Osteopathic Medical Examiners

·        Pharmacy

·        Respiratory Care

·        Physical Therapy

 

The extended Sunset date for these boards is 2009.

 

  • HB 145 also extends the Sunset dates for the following independent boards that are not attached to RLD:

 

·        Nursing

·        Medical Examiners

 

The extended Sunset date for these boards is also 2009.

 

     Significant Issues

 

  • Current law requires legislative review and reauthorization of these boards every 5 years.

 

  • Failure to extend the Sunset dates for these boards will result in their ceasing, at least as state entities, to protect the public through licensure, the adoption of practice standards, and enforcement within their professional fields.

 

FISCAL IMPLICATIONS

 

  • These boards are funded through OSF, not the general fund.  The revenue they generate through exam fees, licensing fees, renewal fees, administrative penalties, and the like, is used to directly support their administration. 

 

  • There are approximately 25 boards administratively attached to RLD.  At this time, their administration costs are consolidated and shared.  Some of the larger boards underwrite the costs of smaller boards.  If the above identified boards were to be Sunsetted, it would likely affect the administrative / operational stability of the remaining boards administratively attached to RLD.
