     Synopsis of SFl Amendment #1

 

The Senate Floor Amendment clarifies that the per diem and mileage expenses for members of the Film Advisory Board apply only to in-state travel.

 

     Synopsis of SFC Amendment

 

The Senate Finance Committee amendment to this bill strikes the $100.0 appropriation. 

 

EDD believes that it will need additional resources to administer the 30-person board.  The bill allows the members to be paid per diem and mileage.  Even if the board meets only quarterly, as required by the bill, these expenses could easily reach between $20.0 and $30.0. 

 

     Synopsis of Original Bill

 

The Senate Finance Committee Substitute for Senate Bill 320 creates the thirty-member “Film Advisory Board” which would be staffed by the Economic Development Department (EDD).  Board members would be appointed by the governor.  The board will advise EDD and the governor on the promotion of the film industry in New Mexico.  It would also assist EDD in developing a New Mexico “media infrastructure” and a workforce training program for film production.  The thirty board members would not be paid, but could receive per diem and mileage.  Of the board members, a seven-member “executive board” would be appointed by the governor.

 

The bill appropriates $100.0 from the general fund to EDD to administer the board.

 

     Significant Issues

 

On January 16, 2003, Governor Richardson announced the creation of the “New Mexico Film Advisory Board” and said that film actress Shirley MacLaine will serve as chairwoman. 

 

The board created by this bill is composed of up to thirty members appointed by the governor.  Seven members, of whom five should have film industry experience, will constitute the executive board. 

 

The only deliverable called for by the bill is an annual report to EDD, the governor and the legislature.

 

EDD supports this bill. It believes a large board will allow diverse representation of film and media issues in New Mexico.  EDD reports that several initiatives mentioned in the bill, such as the workforce training program, are already underway.    

 

FISCAL IMPLICATIONS

 

The appropriation of $100.0 contained in this bill is a recurring expense to the general fund.  Any unexpended or unencumbered balance remaining at the end of fiscal year 04 shall revert to the general fund.

 

The appropriation of $100.0 is intended to provide for administrative costs, including per diem and mileage expenses, related to the new board. 

 

ADMINISTRATIVE IMPLICATIONS

 

EDD notes that staff resources of the New Mexico Film Office will be tapped to support the board.

This bill relates to the recommended appropriation of $546.1 for the New Mexico Film Office in the General Appropriation Act of 2004.

 

 

OTHER SUBSTANTIVE ISSUES

 

The New Mexico Film Office, with 7 FTEs, is one of EDD’s six divisions.  It is considered part of the Community Development Program for purposes of performance-based budgeting.  The FY04 LFC budget recommendation for the Film Office is $546.1.
