     Synopsis of HAFC Amendment

 

The House Appropriation and Finance Committee Amendment strikes the language which refers to the creation of two additional judgeships, thus resulting in the creation of only one judgeship for the thirteenth judicial district in Valencia County.

     Synopsis of Original Bill

 

The Senate Judiciary Committee Substitute for Senate Bill 917 amends Section 34-6-16 NMSA 1978 to provide for additional judgeships for the thirteenth judicial district for Valencia and Sandoval Counties.  The effective date of the provisions of this act is July 1, 2003.

 

     Significant Issues

 

An appropriation in the amount of $275.0 has been included in the Senate Finance Committee Amendments to House Appropriations and Finance Committee Substitute for House Bills 2, 3, 4, 5, 6, and 9 for a judgeship in the thirteenth judicial district.  The appropriation of $275.0 would provide funding for a district judge, trial court administrator, bailiff, court reporter and other operating costs (please see attachment).  This appropriation is contingent on the passage of the Senate Judiciary Substitute for Senate Bill 917.

 

FISCAL IMPLICATIONS

 

The appropriation of $586,580 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.  The appropriation includes funding for salaries and benefits, furniture, supplies and equipment for two additional judges and support staff.

 

DUPLICATION

 

This bill duplicates an appropriation in the General Appropriation Act for a judgeship in the thirteenth judicial district.
