FOR THE LEGISLATIVE HEALTH AND HUMAN SERVICES COMMITTEE

 

AN ACT

RELATING TO MEDICAID; AUTHORIZING THE CREATION OF A MEDICAID WAIVER PROGRAM TO MATCH COUNTY INDIGENT FUNDS WITH FEDERAL MEDICAID FUNDS IN COUNTIES WILLING TO PARTICIPATE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Public Assistance Act is enacted to read:

     "[NEW MATERIAL] COUNTY INDIGENT FUNDS--MEDICAID WAIVER AUTHORIZATION.--Subject to the availability of state funds and consistent with the federal Social Security Act and the signed agreement of the various counties electing to participate, the department shall create a medicaid waiver program permitting the use of county indigent funds to be matched with federal medicaid funds in order to provide expanded services to eligible individuals who:

          A. are New Mexico residents; and

          B. are determined to be eligible for medicaid under the provisions of the waiver."
