AN ACT

RELATING TO LICENSING; AMENDING THE LICENSE FEES AND STRUCTURE FOR SECURITY GUARDS; INCREASING LATE FEES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 61-27A-7 NMSA 1978 (being Laws 1993, Chapter 212, Section 7) is amended to read:

     "61-27A-7. LICENSE FEES.--Each applicant for licensure shall pay a fee set by the department not to exceed the following:

          A. private investigator, initial license or renewal, two hundred dollars ($200);

          B. private investigator manager, initial license or renewal, one hundred dollars ($100);

          C. private investigator employee, initial registration or renewal, fifty dollars ($50.00);

          D. private patrol operator, initial license or renewal, two hundred dollars ($200);

          E. private patrol operator manager, initial license or renewal, one hundred dollars ($100);

          F. private patrol operator employee, also known as a security guard:

                (1) level I guard, initial [registration] license or renewal, twenty-five dollars ($25.00);

                (2) level II guard, initial license or renewal, fifty dollars ($50.00); and

                (3) advanced level III guard, initial license or renewal, one hundred dollars ($100);

          G. branch office, initial license or renewal fee, seventy-five dollars ($75.00);

          [H. change in license status, one hundred dollars ($100);

          I.] H. polygraph examiner, initial license or renewal, three hundred dollars ($300);

          [J.] I. polygraph applicant examination, fifty dollars ($50.00); and

          [K.] J. late fee for failure to renew a license or registration within the allotted time period:

                (1) thirty days or less, fifty dollars ($50.00);

                (2) more than thirty but less than ninety days, one hundred dollars ($100); and

                (3) ninety days or more, one hundred fifty dollars ($150)."
