AN ACT

RELATING TO PUBLIC PROCUREMENT; REQUIRING PUBLIC CONTRACTS FOR THE PERFORMANCE OF SERVICES TO PROVIDE THAT ONLY CITIZENS AND PERSONS AUTHORIZED TO WORK IN THE UNITED STATES BE EMPLOYED UNDER THE CONTRACT OR ANY SUBCONTRACT AWARDED UNDER THE CONTRACT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Procurement Code is enacted to read:

     "[NEW MATERIAL] CONTRACT TERMS FOR SERVICES AND PROFESSIONAL SERVICES.--A state agency or local public body shall include in a contract for the performance of services or professional services a provision that specifies that only citizens of the United States and persons authorized to work in the United States pursuant to federal law may be employed in the performance of services or professional services under the contract or any subcontract awarded under the contract."

     Section 2. [NEW MATERIAL] HOME RULE MUNICIPALITIES--CONTRACT TERMS FOR SERVICES AND PROFESSIONAL SERVICES.--A municipality organized pursuant to the provisions of the Municipal Charter Act shall include in a contract for the performance of services or professional services provisions that specify that only citizens of the United States and persons authorized to work in the United States pursuant to federal law may be employed in the performance of services or professional services under the contract or any subcontract awarded under the contract.

      Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2004.
