AN ACT

RELATING TO ARREST RECORDS; AUTHORIZING THE DEPARTMENT OF PUBLIC SAFETY TO CHARGE A FEE FOR CRIMINAL HISTORY BACKGROUND CHECKS; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Arrest Record Information Act is enacted to read:

     "[NEW MATERIAL] DEPARTMENT OF PUBLIC SAFETY--FEE.--The department of public safety may charge an administrative fee of up to fifty-three dollars ($53.00) for processing fingerprint-supported arrest record information maintained by the department. For each fifty-three-dollar ($53.00) fee collected, seven dollars ($7.00) is appropriated to the general fund and the remainder is appropriated to the department of public safety to defray the administrative costs of maintaining and updating law enforcement records. The department of public safety shall provide an annual report to the legislative finance committee at its October meeting on the status of maintaining and updating law enforcement records and the need to continue the administrative fee."

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
