AN ACT

RELATING TO CRIMES; CREATING THE CRIMES OF ESCAPE FROM AN INTENSIVE SUPERVISION PROGRAM AND ESCAPE FROM A COMMUNITY CORRECTIONS PROGRAM.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section 31-21-13.2 NMSA 1978 is enacted to read:

     "31-21-13.2. [NEW MATERIAL] INTENSIVE SUPERVISION PROGRAM--ESCAPE.--

          A. A person who is placed in an intensive supervision program before completing the person's basic prison term and who willfully absconds or escapes from the supervision of an intensive supervision program with the intent not to return is guilty of an escape.

          B. A person convicted of violating Subsection A of this section is guilty of a fourth degree felony and shall be sentenced pursuant to Section 31-18-15 NMSA 1978."

     Section 2. A new section of Chapter 33, Article 9 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] COMMUNITY CORRECTIONS PROGRAM--ESCAPE.--

          A. A person who is placed in a community corrections program before completing the person's basic prison term and who willfully absconds or escapes from the supervision of a community corrections program with the intent not to return is guilty of an escape.

          B. A person convicted of violating Subsection A of this section is guilty of a fourth degree felony and shall be sentenced pursuant to Section 31-18-15 NMSA 1978."

     Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2005.
