AN ACT

RELATING TO PUBLIC SCHOOLS; PROVIDING FOR AFTER SCHOOL TUTORING PROGRAMS STATEWIDE FOR STUDENTS IN GRADES ONE THROUGH SIX; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 22, Article 13 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] AFTER SCHOOL TUTORING PROGRAMS--GRADES ONE THROUGH SIX.--Every school district shall provide after school tutoring programs for students in grades one through six. In offering the programs, a school district may use teachers employed by the district or may contract with private-sector teaching programs that employ teachers who have experience in classroom instruction. The tutoring programs shall teach reading, language arts and mathematics, and may teach other subjects as determined by the school district."

     Section 2. APPROPRIATION.--Six million three hundred thousand dollars ($6,300,000) is appropriated from the general fund to the public education department for expenditure in fiscal year 2006 to distribute to school districts for after school tutoring programs provided for in Section 1 of this act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2006 shall revert to the general fund.

     Section 3. APPLICABILITY.--This act applies to the 2005-2006 and subsequent school years.
