AN ACT

RELATING TO SCHOOL PERSONNEL; MAKING EMPLOYEES OF SCHOOL BUS CONTRACTORS EMPLOYEES OF THE SCHOOL DISTRICT FOR SALARY AND BENEFIT PURPOSES; PAYING THE EMPLOYER SHARE OF SCHOOL BUS CONTRACTOR EMPLOYEE BENEFITS; MAKING AN APPROPRIATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the School Personnel Act is enacted to read:

     "[NEW MATERIAL] EMPLOYEES OF SCHOOL BUS CONTRACTORS EMPLOYEES OF SCHOOL DISTRICT FOR SALARY AND BENEFIT PURPOSES.--Employees of school bus contractors shall be considered employees of the school district for salary and benefit purposes, including group health insurance. The school district shall pay the employer's share of the school bus contractor employee's benefits."

     Section 2. APPROPRIATION.--Thirteen million eight hundred sixty-seven thousand two hundred dollars ($13,867,200) is appropriated from the general fund to the public education department for expenditure in fiscal year 2006 to cover school districts' employer share of employee benefits for school bus contractor employees. Any unexpended or unencumbered balance remaining at the end of fiscal year 2006 shall revert to the general fund.
