AN ACT

RELATING TO STATE PROCUREMENT; AMENDING THE PROCUREMENT CODE TO REQUIRE THE APPROVAL OF THE ATTORNEY GENERAL BEFORE A STATE AGENCY ENTERS INTO CERTAIN CONTRACTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Procurement Code is enacted to read:

     "[NEW MATERIAL] CONTRACTS--ATTORNEY GENERAL REVIEW.--

          A. Contracts entered into by a state agency that are not exempt from the provisions of the Procurement Code and that have a total cost in excess of two hundred thousand dollars ($200,000) shall be reviewed and approved by the office of the attorney general before final approval can be given by the contracting state agency.

          B. The provisions of this section do not apply to contracts for emergency procurements pursuant to the provisions of Section 13-1-127 NMSA 1978."
