    Your CONSERVATION COMMITTEE, to whom has been referred


SENATE BILL 123


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 2, line 24, after "to" strike the remainder of the line, strike line 25 in its entirety and on page 3, strike line 1 up to the period and insert in lieu thereof "authorize the interstate stream commission to acquire water rights contrary to Section 72-1-2.4 NMSA 1978".


    2. On page 3, lines 2 and 3, strike "recognized by the state engineer to" and insert in lieu thereof "that".


    3. On page 3, strike lines 16 and 17 in their entirety and on line 18, strike "involving state and federal agencies and water users" and insert in lieu thereof "water management efforts for the benefit of threatened or endangered species".


    4. On page 3, line 19, after the period insert the following:


    "Management of water pursuant to this subsection shall be done in conjunction with collaborative programs or processes where they exist.".


    5. On page 4, between lines 13 and 14, insert a new sentence to read:


    "Nothing in this section shall modify or repeal any authority currently vested in any organization described in this subsection.".


    6. On page 5, line 20, strike "and".



    7. On page 5, line 22, strike the period and insert in lieu thereof "; and".


    8. On page 5, between lines 22 and 23, insert a new paragraph to read:


             "(3) that the office of the state engineer transfer procedures shall be followed.".,


and thence referred to the FINANCE COMMITTEE.
