    Your CONSERVATION COMMITTEE, to whom has been referred


SENATE BILL 142


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 1, line 23, strike "FINDINGS AND".


    2. On page 1, strike line 25 in its entirety.


    3. On page 2, strike lines 1 through 14 in their entirety and on line 15, strike the subsection designation "B.".


    4. Change the subsequent paragraph numerical designations to subsection alphabetic designations accordingly.


    5. On page 3, line 15, strike "but does not include" and strike line 16 through "wetlands".


    6. On page 4, between lines 21 and 22, insert a new Subsection L to read:


         "L. "illegal dumpsite" means a place where illegal dumping has occurred;".


    7. Reletter the succeeding subsections accordingly.


    8. On page 6, line 1, after "household" insert "or in agricultural operations".


    9. On page 6, line 23, after "conveyance" insert "or enclosure".


    10. On page 9, line 12, strike "solid waste" and insert in lieu thereof "scrap tire".

    11. On page 11, line 19, strike "representatives from" and insert in lieu thereof "one member representing each".


    12. On page 11, line 22, after "retailers" insert a comma and strike "and" and insert in lieu thereof "agricultural producers, soil and water conservation districts and".


    13. On page 11, line 24, after "alliance" insert "to serve two-year terms as volunteers with no compensation from the state".


    14. On page 21, between lines 2 and 3, insert:


         "D. The court may also allow the prevailing party, as part of the costs, the money paid for reasonable attorney fees in the district and supreme courts.".


    15. On page 21, line 15, after the period insert: "The first priority for funding shall be abatement of illegal scrap tire dumpsites and the recycling of scrap tires.",


and thence referred to the JUDICIARY COMMITTEE.
