    Your JUDICIARY COMMITTEE, to whom has been referred

SENATE BILL 432

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 2, line 22, before the semicolon insert "but does not include chaining, restraining or otherwise affixing the animal to a stationary object".

    2. On page 7, line 10, strike "and".

    3. On page 7, between lines 10 and 11, insert the following new paragraph:

             "(5) the dangerous dog will not be transported in a vehicle that might allow the dog to escape or gain access to any person or animal outside the vehicle; and"

    4. Renumber the succeeding paragraph accordingly.

    5. On page 9, between lines 16 and 17, insert the following new subsection:

         "F. Prosecution pursuant to this section requires a showing that:

             (1) an owner knew of the propensity of a dog to inflict serious injury; or

             (2) the dog had previously been found by a court to be a dangerous or potentially dangerous dog.".

    6. On page 3, line 6, after the word person, insert "or domestic animal".
