    Your INDIAN AND CULTURAL AFFAIRS COMMITTEE, to whom has been referred


SENATE BILL 1038


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1.  On Page 1, line 11, after the semicolon insert "REQUIRING

MAINTENANCE OF" and after "ROUTES" strike "MAINTAINED".


    2.  On page 2, line 21, after "district" strike the remainder

of the line, strike lines 22 through 24 in their entirety and insert

in lieu thereof:


"may provide school transportation services to students who reside

outside of the school district boundary, provided that an agreement

is made by the adjoining school district in accordance with rules of

the department. In the event that an agreement cannot be reached,

the school districts shall seek arbitration. Unless otherwise

provided for by rule adopted by the department, the procedures for

arbitrator shall be governed by the Uniform Arbitration Act. No

arbitrator shall be subject to liability for actions taken pursuant

to this section.".


    3.  On page 3, line 1, strike "B" and insert in lieu thereof

"E".


    4.  On page 3, line 2, strike "within or".


    5.  On page 3, strike line 3 in its entirety.,


and thence referred to the EDUCATION COMMITTEE.
