SUMMARY
Synopsis of HGUAC Amendment
The House Government and Urban Affairs Committee amendment makes a technical correction.
On page 2, line 7 of the bill, the correct subsection references are changed from “A or B” to “B
or C”.
Synopsis of Bill
House Bill 209 requires the Secretary of State to establish the “New Mexico Community Land
Grant Registry” in which the bylaws and lists of current officers of the state’s community land
grants are to be registered. The bill applies to community land grants organized and governed
pursuant to Section 49-1-1 through 49-1-18 NMSA 1978 and operating as political subdivisions
of the state. The bill allows land grant organizations to request that the Secretary of State keep on
file current or historical documents of maps submitted by the board of trustees of a land grant
organization, provided that the Secretary of State can store these documents at the State Records
Center and Archives.

The bill requires the Secretary of State to imitate the required process of registering bylaws, lists
of current officers and other relevant information for community land grants that the Secretary of
State has in place for corporations and partnerships.
Significant Issues
Laws 2004, Chapter 124, Section 3 provides that all land grants in Section 49-1-1 through 49-1-
18 NMSA 1978 are political subdivisions of the state.
ADMINISTRATIVE IMPLICATIONS
According to the Secretary of State, the provisions of this bill are already being implemented for
corporations and partnerships and will not pose an administrative burden to the Secretary of
State.
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL.
The bylaws and lists of current officers of community land grants in the state will not be regis-
tered with the Secretary of State.
