SUMMARY
Synopsis of Bill
House Bill 401 allows for the issuance of citations for certain traffic violations based on evi-
dence gathered from automated traffic enforcement systems. The proposed legislation would
authorize the use of cameras in recording and issuing citations for misdemeanor offenses. The
proposed legislation also allows police departments to create forms to use in issuing these cita-
tions.
PERFORMANCE IMPLICATIONS
AODA states few District Attorneys’ offices are involved in the prosecution of traffic citations.
Many offices assist law enforcement agencies on a case by case basis. The AODA anticipates
that there will be more requests for assistance.

OTHER SUBSTANTIVE ISSUES
AODA states they anticipate that many cases will be contested on the issue of identity of the
driver.
DPS reports the proposed legislation is unclear as to when enforcement takes place in the event
the violator does not respond within 30 days.
