SUMMARY
Synopsis of Bill
House Bill 740
amends NMSA Section 65-2A-10 to remove a provision that implies that the
PRC may only consider the interests of competing motor carriers who have filed a protest when
the PRC is deciding whether to issue a new permit for the intrastate transportation of household
goods or people.
Significant Issues
Current law requires that the PRC consider several factors when deciding whether to issue a new
permit for the intrastate transportation of people or household goods. One of those factors is the
effect on existing competition, and “whether granting the permit would endanger or impair the
operations of motor carriers protesting the application for a permit to an extent contrary to the
public interest.” Current law requires the PRC to consider the effect of a new permit on existing
competition, but implies that it may only consider that effect on those companies actually pro-
testing the new permit. This bill will remove that phrase and will allow the PRC to consider the
effect of a new permit on competition, regardless of whether anyone has protested the issuance
of a new permit.
The PRC states this bill is clean-up language to resolve an inadvertent conflict in existing law.
