SUMMARY
Synopsis of Bill
Senate Joint Memorial 96 requests the Legislative Education Study Committee collaborate with
school districts and PED to study the costs of the current federal Individuals with Disabilities
Education Act (IDEA), and the related due process hearing system and offer strategies to reduce
the fiscal impact and increase the efficiency of due process hearings, and to study the coverage
of due process hearings provided by the New Mexico Public School Insurance Authority
(NMPSIA).
Significant Issues
The Joint Memorial requests that the PED review and implement the strategies identified by the
study and that the PED work with LESC to identify an implementation plan for the strategies de-
veloped and present the plan to the Legislature for review by November 2006.
In addition, the legislation requests that the PED and LESC identify the costs and seek appropria-
tions or change in law, where necessary, to implement the strategies agreed upon.
