SUMMARY
Synopsis of SM 40
Senate Memorial 40 proposes to request that the director of the Alcohol and Gaming Division of
the Regulation and Licensing Department create a task force to study, investigate, and recom-
mend electronic technology that could verify age of persons purchasing alcohol in NM.
The memorial further proposes that representatives from the Public Health Division (DOH), NM
sheriffs and police association, NM restaurant association, NM retailers association, NM hospi-
tality association, grocers association, lodgers association, independent petroleum marketers as-
sociation, Mothers Against Drunk Driving, DWI resource Center and other groups have mem-
bership on the proposed task force.
Finally, the memorial proposes that the director of alcohol and gaming and the governor’s DWI
coordinator report to the “appropriate” interim committee on the “status of the electronic age
verification technology” and recommend legislation to facilitate the use in businesses that sell or
serve alcohol.

Significant Issues
The proposed task force would be large, with at least ten members.
There is not a requested deadline for reporting the task forces findings.
The resolution asserts that:
One third of fatal motor vehicle collisions in NM are caused by drivers 15-20 and are al-
cohol related.
There are proportionally more young people under the age of 21 in NM that drink and
drive than over the age of 21 that drink and
Nineteen percent of NM high school students drink compared with thirteen percent na-
tionwide.
PERFORMANCE IMPLICATIONS
All agencies involved my lose workforce time for the purposes of the proposed study.
FISCAL IMPLICATIONS
No appropriation is proposed. Future legislation resulting from the task force could have fiscal
implications.
ADMINISTRATIVE IMPLICATIONS
Administrative time would be used towards the task force.
ALTERNATIVES
A time frame could be proposed for the task force to return with recommendations.
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL.
A task force to determine electronic technology devices for age detection would likely not form
and report.
