A JOINT MEMORIAL

REQUESTING THE REGULATION AND LICENSING DEPARTMENT AND THE ATTORNEY GENERAL TO STUDY THE LAWS AND RULES GOVERNING THE REGULATION OF THE ELEVATOR INDUSTRY TO DETERMINE IF EXISTING PROVISIONS PROVIDE ADEQUATE PROTECTION FOR THE PUBLIC.

 

     WHEREAS, building codes provide for the installation of elevators to ensure the safety of the public; and

     WHEREAS, continuing safe operations and maintenance of elevators are not ensured by state inspection; and

     WHEREAS, other states have enacted regular elevator inspection and operation and maintenance safety rules;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the regulation and licensing department and the attorney general, in consultation with the national elevator industry and the international union of elevator constructors, be requested to study the laws, building codes and rules governing the regulation of the elevator industry to determine if existing provisions are adequate to protect the public; and

     BE IT FURTHER RESOLVED that the regulation and licensing department report its findings and recommendations for legislation to the legislature by December 1, 2005; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the superintendent of regulation and licensing, the governor and the attorney general.
